Terms and Conditions – Artletshop

These Terms and Conditions (“Terms”) regulate your use of the website https://artletshop.com and the purchase of goods from Artletshop (“we”, “our”, “us”). By using our website or placing an order, you agree to these Terms.

Note: Persons under 18 years of age may not purchase goods from this website.

1. Definitions

Goods: Any products available for sale on Artletshop.
Carrier: Any person or company contracted by us to deliver Goods.
Website: All computing hardware and software that supports our site.
Content: Information published on our website by us or with our consent.

2. Our Contract with You

Orders are accepted via email confirmation, which will include purchase details and estimated delivery.
We may update these Terms at any time; the version on the website at the time of your order applies.
If Goods are unavailable, we will offer alternatives or allow you to cancel the order.
Refunds due to cancellations or errors will be processed within 30 days.

3. Price and Payment

Full payment must be made before dispatch.
Any banking or currency conversion fees (outside EUR) are borne by the customer.
Payments are made without set-off or deductions.

4. Your Information

You must provide accurate, up-to-date, and complete information for your orders.
We will acknowledge your complaint within 14 days and provide a response or resolution within 30 days of purchase.

5. Delivery

Goods are delivered to the address provided by you.
You are responsible for ensuring someone is available to receive the delivery.
Tracking information will be sent via email once your order ships.

6. International Orders

We may deliver outside Croatia, depending on feasibility.
Delivery prices for international orders may vary; inquiries can be made via our contact form.

7. Returns and Refunds

Goods may be returned within 7 days of delivery at your cost, with proof of postage.
Items must be in their original condition and packaging, including the delivery slip.
Refunds are processed to the original payment method within 30 days of receipt.
Damaged items must be reported with photos within 3 days of delivery.

8. Disclaimers and Limitation of Liability

We make no warranties regarding the suitability, accuracy, or legality of Goods or Content.
We are not liable for indirect, special, or consequential damages, or losses from using the website or purchasing Goods.
Our total liability is limited to the value of the purchased Goods in the specific order.

11. Third Party Rights

These Terms do not confer any rights on third parties under the Contracts (Rights of Third Parties) Act 1999.

12. Severability and No Waiver

If a provision is invalid or unenforceable, it will be amended to be enforceable to the minimum extent necessary.
Failure or delay to exercise a right does not constitute a waiver.

13. Dispute Resolution

Any disputes should first be attempted to be resolved via good faith mediation before arbitration or litigation.

14. Force Majeure

We are not liable for breaches caused by circumstances beyond our control, including strikes or technical failures.

15. Governing Law

These Terms are governed by the laws of Croatia / EU.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.
